These Terms & Conditions ("Terms") govern the use of Workwalaa Hire, a technology marketplace platform operated by Conecxia Enterprises LLP, Kozhikode, Kerala, India ("Workwalaa", "Workwalaa Hire", "Platform", "we", "our", or "us"). By accessing or using the platform, you agree to be bound by these Terms.
1. Nature of Platform
Workwalaa Hire is a B2B technology marketplace platform that connects companies with recruitment agencies, educational institutions, talent partners, and candidate sourcing partners ("Agencies").
Workwalaa Hire operates solely as an intermediary technology platform for candidate discovery and marketplace access.
Workwalaa Hire:
- does not employ candidates
- does not act as an employer
- does not guarantee hiring outcomes
- does not guarantee candidate quality
- does not supervise employees
- does not guarantee joining, retention, or performance
- does not participate in employer employee relationships
The platform only provides access to candidate submissions and marketplace discovery tools.
2. Eligibility
Users must:
- be at least 18 years old
- provide accurate registration information
- possess legal authority to represent their organisation
- comply with applicable Indian laws and regulations
Workwalaa reserves the right to verify identity, business legitimacy, and account authenticity at any time.
3. Account Registration
To access certain features, users may be required to create an account.
Users agree to:
- provide accurate information
- maintain account confidentiality
- avoid sharing login credentials
- avoid account transfers or unauthorised access
Workwalaa may suspend or terminate accounts found to contain false, misleading, fraudulent, or incomplete information.
4. Marketplace Access Model
Companies may post hiring requirements on the platform.
Agencies may submit candidates matching those requirements.
Companies may: view submission counts, review marketplace activity indicators.
However, candidate resumes, contact details, and profiles remain restricted until the applicable Marketplace Access Fee is paid.
Payment of the Marketplace Access Fee grants temporary access to candidate profiles submitted for the selected vacancy.
5. Marketplace Access Fee
Workwalaa charges a Marketplace Access Fee for unlocking candidate submissions.
The Marketplace Access Fee:
- is charged per vacancy
- grants temporary access to candidate profiles and resumes
- does not guarantee hiring success
- does not guarantee candidate quality
- does not guarantee candidate availability
- is non refundable after candidate submissions are accessed
Workwalaa reserves the right to modify platform pricing, fees, penalties, payout structures, and commercial terms at any time.
6. Additional Hire Fees
Where applicable, additional fees may apply for multiple successful candidate selections under the same vacancy.
Companies are responsible for accurately updating candidate selection status on the platform. Additional hire fees (₹3,000 per additional selected candidate) will appear in Pending Payments and must be cleared within 6 days. Delayed payments may incur additional late charges up to ₹1,000.
Failure to accurately report hiring activity may result in:
- late fees
- payout disputes
- account suspension
- permanent platform restrictions
6A. Undeclared Hiring & Compliance
If WorkWalaa Hire reasonably determines through investigation that a company hired candidates sourced through the platform but intentionally failed to declare, update, or mark those hires in order to avoid additional hiring fees, agency payouts, or platform charges, WorkWalaa Hire reserves the right to:
- suspend or terminate account access
- freeze platform hiring activity
- recover unpaid platform charges
- initiate compliance investigation
- impose contractual recovery charges, investigation costs, and platform damages
Contractual recovery may extend up to ₹30,000 per undeclared hire depending on:
- investigation findings and evidence submitted
- repeated violations or pattern of non-compliance
- operational damages caused to the platform or agencies
A portion of recovered damages may be allocated toward affected agency compensation where applicable.
Investigation Evidence
During dispute or compliance investigations, WorkWalaa Hire may review:
- joining confirmations and onboarding proof
- candidate communications and offer letters
- attendance confirmations and hiring evidence
- platform activity logs, timestamps, and audit trails
- any other relevant documentation provided by agencies or companies
Companies and agencies agree to cooperate in good faith with any compliance investigation initiated by the platform. Failure to cooperate may be treated as an adverse inference against the non-cooperating party.
7. Candidate Submission Rules
Agencies are solely responsible for:
- candidate authenticity
- candidate consent
- resume accuracy
- experience verification
- document legitimacy
- skill representation
- submission quality
Agencies confirm that:
- candidates have consented to data sharing
- submitted information is accurate to the best of their knowledge
- submissions match vacancy requirements
Workwalaa does not independently verify:
- resumes
- certificates
- employment history
- candidate behaviour
- candidate qualifications
8. Duplicate Candidate Protection
Candidate submissions are protected through platform validation systems.
Where duplicate submissions occur:
- priority may be assigned to the first valid submission
- platform records and timestamps may determine ownership eligibility
- Workwalaa reserves final authority in submission disputes
Workwalaa may reject duplicate or suspicious submissions at its discretion.
9. Temporary Access and Candidate Visibility
Candidate access granted through the platform is temporary.
Workwalaa may:
- restrict candidate visibility
- remove shortlist visibility
- expire vacancy access
- limit resume access periods
- remove candidate records from company dashboards after defined durations
Companies are prohibited from attempting to bypass platform restrictions or marketplace protections.
10. Agency Ranking and Visibility System
Workwalaa may use automated or manual systems to determine:
- agency rankings
- visibility
- submission priority
- marketplace exposure
- trust scores
- quality scores
Ranking may be influenced by:
- hiring success
- submission quality
- duplicate rates
- dispute history
- candidate performance signals
- company feedback
Workwalaa reserves full authority over marketplace visibility systems.
11. Company Responsibilities
Companies agree to:
- provide genuine hiring requirements
- maintain accurate hiring status
- avoid bypassing marketplace payments
- avoid hidden hiring activity
- cooperate during disputes
- avoid misuse of candidate information
Companies must update candidate status within the timeframe specified by the platform.
Failure to report successful selections may result in:
- penalties
- late fees
- payout holds
- account suspension
- permanent bans
12. Agency Responsibilities
Agencies agree to:
- submit genuine candidates only
- avoid spam submissions
- avoid fake resumes
- avoid forged documents
- avoid misleading information
- avoid duplicate manipulation
- maintain candidate communication
- verify joining status independently
Agencies are solely responsible for monitoring whether their submitted candidates were selected or joined.
Workwalaa is not obligated to independently track candidate joining outcomes on behalf of agencies.
13. Prohibited Activities
Users may not:
- violate Indian law
- post illegal job opportunities
- promote fraudulent schemes
- upload forged documents
- engage in identity theft
- scrape platform data
- misuse candidate information
- attempt unauthorised access
- bypass platform payments
- interfere with platform operations
- exploit technical loopholes
- distribute malware or harmful software
Workwalaa may immediately suspend accounts involved in prohibited activities.
14. Data Confidentiality
Company identities, agency identities, candidate information, and marketplace data may be partially restricted to protect marketplace integrity and anti bypass mechanisms.
Users may not:
- resell platform data
- publicly distribute candidate information
- scrape marketplace information
- use platform data outside authorised purposes
15. Dispute Resolution
Disputes may be raised through official support channels within the timelines defined by the platform.
During investigations, Workwalaa may request:
- joining proofs
- communication records
- offer letters
- payment references
- identity verification documents
Workwalaa reserves the right to:
- freeze payouts
- suspend access
- investigate suspicious activity
- manually review disputes
- enforce marketplace penalties
Platform decisions regarding operational disputes may be treated as final for platform governance purposes.
16. Technical Limitations
Workwalaa does not guarantee uninterrupted platform availability.
The platform may experience:
- maintenance downtime
- technical failures
- third party outages
- payment gateway delays
- server interruptions
- cloud infrastructure failures
Workwalaa shall not be liable for:
- delayed access
- delayed payouts
- temporary outages
- failed uploads
- failed notifications
- data transmission interruptions
17. Force Majeure
Workwalaa shall not be liable for delays or failures caused by events beyond reasonable control, including:
- internet outages
- cyberattacks
- natural disasters
- government restrictions
- labour strikes
- infrastructure failures
- payment gateway disruptions
- cloud service failures
18. Platform Moderation Rights
Workwalaa reserves the right to:
- suspend accounts
- ban users
- remove listings
- restrict visibility
- reject submissions
- freeze payouts
- modify marketplace rules
- adjust ranking systems
- change platform features
- update pricing structures
These actions may be taken without prior notice where necessary for platform protection.
19. Limitation of Liability
To the maximum extent permitted under applicable law, Workwalaa Hire and Conecxia Enterprises LLP shall not be liable for:
- hiring failures
- candidate misconduct
- employee behaviour
- salary disputes
- workplace disputes
- business losses
- missed opportunities
- indirect damages
- loss of profits
- reputational damages
- operational interruptions
Workwalaa's total liability, if any, shall be limited to the amount directly paid to the platform for the relevant transaction.
20. No Employment Relationship
Nothing in these Terms creates:
- employment relationships
- agency relationships
- partnership relationships
- staffing obligations
- recruitment guarantees
All hiring decisions remain solely between companies and candidates.
21. Amendments
Workwalaa reserves the right to modify these Terms at any time.
Continued use of the platform after updates constitutes acceptance of revised Terms.
22. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India.
Any disputes arising from platform usage shall fall under the jurisdiction of courts located in Kerala, India.
